AI for private and Catholic high schools
Fewer federal rules apply to private schools, but the ones that matter most still do. How independent and Catholic high schools can approve AI quickly and carefully.
Which rules apply to a private school
For a Catholic or independent school without federal education funds, as of Oct 18, 2026. Not legal advice.
| Rule | Applies? |
|---|---|
| FERPA, PPRA | Generally no; such schools generally do not receive covered funds |
| CIPA | Only if the school takes E-rate; schools with endowments over $50 million or run for profit cannot |
| COPPA | Yes, for users under 13; it binds the operator |
| California SOPIPA, Illinois SOPPA | Yes in those states; SOPPA names nonpublic schools |
| New York 2-d, Maryland 4-131 | No; tied to public schools |
| Maryland Online Data Privacy Act and Kids Code | Yes above thresholds; private-school data is not FERPA data |
| State chatbot laws (CA, NY, WA, OR) | Yes; they bind the operator by user location |
| AI provider terms; your contract | Yes |
Build to the public-school standard anyway
Fewer federal rules apply, but the obligations that matter most still do: COPPA, state laws that bind the vendor, the AI provider's terms for minors, and your contract. Families expect public-school protections, and an agreement written to that standard travels if you ever take federal funds. Ask any AI vendor for school ownership of data, no sale, ads or training, a retention schedule, deletion on request and breach notice.
You can decide faster
Independent Catholic schools decide locally, and private budgets come from tuition, so a head of school can approve a pilot without a district's procurement cycle. Use that speed for a careful pilot rather than a fast rollout: one or two courses, six weeks, and a readout before the budget closes. Read how to run a six-week AI pilot.
Keep it in proportion
The median NAIS school spent $527 per student on technology. An AI line should be judged against that whole budget: what it adds, what it replaces, and what it costs per active student. Read budgeting AI per student.
Families are asking about AI schools
Parents now hear about AI-first private schools. Alpha School's tuition runs from $10,000 to $75,000, and its Bethesda, Maryland K-8 campus lists $65,000. Families want to know what your school is doing. A clear answer: "We use real AI, with our teachers and our rules." Read Alpha School and Nexus.
Equal access inside a tuition school
Even in a tuition-funded school, families pay very different amounts for AI at home. In a 2024 Harvard survey, 40% of undergraduate AI users without financial aid paid for AI products, against 20% of those with aid; that is one college, but the pattern is worth checking in your own community. A school-provided AI gives scholarship and aid students the same models as everyone else.
Systems independent schools run
Many independent schools run Blackbaud. Nexus has built a Blackbaud assignment connection, not yet run against a real school account, and pasted assignments work today. See Nexus and Blackbaud.

Questions and answers
Does FERPA apply to private schools?
Generally not, when the school does not receive federal education funds. COPPA, state vendor laws, provider terms and your contracts still apply.
Can a private school use AI with students?
Yes. Private schools decide locally. Use a written policy, a data agreement written to the public-school standard and a short pilot.
How should a Catholic high school approach AI?
Decide what students must keep doing themselves, choose an AI with rules students cannot switch off, settle who can see student chats, check provider terms for minors and pilot in one or two courses.
What do independent schools spend on technology?
The median NAIS school spent $527 per student on technology (NAIS Facts at a Glance 2025-26).
